By submitting this application, you acknowledge and agree to the following:
1. Purpose of Application
This application is used to establish character and residential history. It does not constitute an agreement to rent or approve purchase. All applications require written approval from the Association.
2. Occupancy Disclosure and Approval
You must disclose all intended occupants and obtain Board of Directors approval prior to closing or move-in. Failure to disclose all occupants or obtain required approval may result in the Association denying occupancy, imposing penalties, or canceling the transaction under its governing documents and applicable law.
3. Truthfulness and Accuracy
You declare that all statements provided are true and correct. Where allowed by law, the Association may terminate any agreement entered into based on misstatements or omissions in this application.
4. Application Fees
All application fees are non-refundable unless prohibited by law. Fees are charged immediately upon submission. If any payment is returned or dishonored, you must promptly reimburse the amount owed plus any reversal charges. By submitting this application, you authorize the Association to charge your original payment method for any unpaid or underpaid fees, including fees resulting from undisclosed occupants or buyers at the per-person rates established in this application. If unable to collect via the original payment method, the Association may seek payment directly from you.
5. Animals and Pets
You are responsible for ensuring all animals are current on required vaccinations and registrations as required by local law or Association rules. You must provide proof of compliance to the Association upon request.
6. Drug and Crime-Free Community
To maintain safety and security, you, your household members, guests, and visitors may not engage in or permit the following on or near the premises:
- Illegal drug activity (manufacturing, selling, distributing, using, or possessing controlled substances)
- Criminal activity (threats, physical harm, theft, vandalism, fraud, illegal weapons possession, prostitution)
- Nuisance activities that endanger safety or disturb the peaceful enjoyment of the community
7. Community Rules and Regulations
You agree to abide by all governing documents, rules, and regulations at all times. If notified of a possible violation, you will remedy the situation within the timeframe specified in the notice.
8. Enforcement
These Terms and Conditions remain in effect throughout your occupancy. Violations may result in the Association pursuing all available legal remedies.
